What Happens at the 341 Meeting of Creditors?

The 341 meeting is a brief, routine hearing where a bankruptcy trustee confirms your identity and asks a short list of questions about your paperwork under oath. In Maryland and Florida most of these meetings are now held by Zoom or phone, they usually last about ten minutes, and creditors almost never attend.

It is normal to feel nervous about it. Almost everyone is. Once you know what to expect, it is one of the more straightforward parts of your case.

What the 341 meeting actually is

The 341 meeting, also called the meeting of creditors, is required in every bankruptcy case. Its purpose is simple: the trustee assigned to your case verifies who you are and confirms that the information in your petition is true and complete.

Who runs it

The meeting is run by the trustee, not a judge. The judge is not present. The trustee is there to review your case, not to argue with you or to lecture you.

Do you need to bring anything?

No. You do not need to bring any documents to the meeting. And for your safety, never hold your ID or your Social Security card up to the camera. We verify your identity with the trustee ahead of time, so your personal information stays protected. All you need to do is show up on time and answer honestly.

What the trustee asks

The questions are standard. Expect to be asked whether you reviewed and signed your petition, whether the information in it is true and complete, whether you listed all of your assets and debts, and whether anything has changed since you filed. The trustee is confirming your paperwork, not trying to catch you out. Answer honestly and simply.

How long it takes

Most meetings last about ten minutes. The trustee often handles several cases in a session, so there may be a short wait for your turn.

Do creditors show up?

Rarely. The meeting is called the meeting of creditors because creditors are allowed to attend, but in typical consumer cases they almost never do.

How to prepare

Review your petition before the meeting so the details are fresh. There is nothing to bring and nothing to print, and you should never show your ID or Social Security card on camera. If your meeting is by video, test your connection in advance and find a quiet, private spot. We handle your identity verification with the trustee ahead of time, prepare you beforehand, and attend the meeting with you.

What happens after

Once the meeting is done, your case moves forward toward discharge. In a Chapter 7 the discharge usually follows about 60 days later if no objections are filed. In a Chapter 13 you continue your repayment plan toward discharge at the end.
