Yes — you can absolutely file bankruptcy if you're unemployed. In fact, having no income or low income makes it easier to qualify for Chapter 7, since the means test is based on your income over the past 6 months. Unemployment may be the best time to file.

How Unemployment Affects Chapter 7 Qualification

The means test looks at your average monthly income over the 6 months before filing. If you've been unemployed for several months, your income average will be low — likely below Maryland's median — making qualification straightforward.

Unemployment benefits are counted as income in the means test, but they're typically much lower than earned wages. This usually still results in qualification.
