How Long Does Chapter 7 Take in Maryland?

A typical Maryland Chapter 7 case runs about three to four months from the day we file to the day you receive your discharge. The automatic stay protects you from day one, so collection calls, garnishments, and lawsuits stop right away, long before the case is over. Your 341 meeting with the trustee usually happens around thirty to forty five days after filing and normally lasts only a few minutes. Your discharge normally arrives about sixty to ninety days after that meeting. Most of the waiting is the court's, not yours.
What the Timeline Looks Like
Before we file. You complete a credit counseling course and we gather your documents. How long this step takes is mostly up to you and how quickly the paperwork comes together. For most clients it is a couple of weeks. If you are facing a garnishment or a sale date we move faster.
Day one, we file. The automatic stay takes effect the moment the case is filed. Collection calls must stop. Garnishments stop. Lawsuits freeze. Foreclosure and repossession are halted. You do not wait for a hearing for any of this.
Around thirty to forty five days, the 341 meeting. You attend a short meeting where the trustee asks a few straightforward questions under oath, usually by video or phone. It typically lasts only a few minutes. We prepare you beforehand so you know exactly what will be asked, and we are with you for it.
About sixty days after the meeting, a waiting period. This is the stretch where nothing appears to happen and it is the part clients find hardest. The court holds the case open for about sixty days after your 341 meeting so creditors and the trustee can raise anything they need to raise. In most cases nobody does, and once that window closes your discharge follows.
Your second course. You complete the financial management course and we file the certificate. This one is easy to forget and it is the most common reason a discharge gets delayed, so we chase it.
About sixty to ninety days after the meeting, discharge. The court issues your discharge order, which legally erases your eligible debts. Your fresh start is official and permanent.
What Can Make It Take Longer
A few things extend the timeline, and none of them are common:
Missing or late documents, which is the one you control
Forgetting the financial management course
The trustee asking follow up questions or requesting more records
A creditor or the trustee raising an objection
Assets the trustee needs to review or administer

Where Maryland Cases Are Filed
Maryland Chapter 7 cases are filed in the United States Bankruptcy Court for the District of Maryland, which has two divisions. The county you live in decides which one handles your case.
Greenbelt Division serves Montgomery County, Prince George's County, and Frederick County.
Baltimore Division serves Baltimore City, Anne Arundel County, and Howard County.
